Consensys to move forward with lawsuit against SEC

Leading Ethereum developer Consensys Software Inc. aims to move forward with its lawsuit against the United States Securities and Exchange Commission (SEC), despite the agency dropping its investigation into the blockchain protocol Ethereum 2.0, Eleanor Terrett, a journalist with Fox Business News reported.

"The SEC's decision to close its 14-month investigation into Ethereum is a welcome development – it’s necessary but not sufficient. There has to be a better way to regulate the market than through ambush," Joseph Lubin, founder of Consensys, told Terrett. Lubin voiced his hope that "antagonism on crypto among some US regulators" is starting to subside.

"Until then, we soldier forth with our litigation against the SEC in Texas because we are intent on achieving more legal clarity for all," he added, as the company, among other things, seeks a declaration saying that offering the user interface software MetaMask Swaps and Staking does not violate securities laws.
