The Grand Chamber of the European Court of Human Rights (ECHR) declared that applications submitted by Ukraine and the Netherlands against Russia concerning the downing of Malaysia Airlines Flight 17 (MH17) and points involving the 2014 conflict are partially admissible.
In line with the ruling, the court will hear Amsterdam's arguments that Moscow was responsible for the MH17 crash, as well as for not carrying out an "effective investigation," while Kiev's submissions revolve around alleged violations of the European Convention on Human Rights in separate events.
Both lines of reasoning are based on the presumption confirmed by the court that "Russia had had effective control over all areas in the hands of separatists from 11 May 2014." Russia submitted a formal letter of withdrawal from the Council of Europe in March 2022 after the organization announced plans to suspend Moscow's membership.
