Judge Eric Davis of Delaware's Superior Court rejected on Friday Fox Corp.'s attempt to dismiss the lawsuit by Dominion Voting Systems and allowed the case to go to trial, which could take place in April.
Earlier, Dominion sued Fox News, seeking $1.6 billion in damages from the company for allegedly perpetuating "a false story of election fraud in order to serve its own commercial purposes." Fox then sought to dismiss the suit by one of the suppliers of election technology in the 2020 elections, claiming the First Amendment ensures media's "free-speech right to inform the public."
Davis backed most of Dominion's motions, except the one accusing Fox of acting with malice in its reporting about the elections.
