Musk seeks trial delay, Twitter deal could close on Oct. 28

Elon Musk's legal team has once again sought a delay to the October 17 start of the trial against Twitter Inc., court filings showed on Thursday.

Attorneys want the Delaware court in charge of the case "to put an end to this dispute and facilitate the prompt closing of this transaction." According to Musk's lawyers, Twitter has "insisted" on going forward with the lawsuit against him, "recklessly putting the deal at risk and gambling with their stockholders' interests."

The two sides should focus instead on "securing the Debt Financing" needed to successfully finish the transition, they pointed out, adding that "by far the most likely possibility is that the debt is funded in which case the deal will close on or around October 28."
