The negotiations between OpenAI and Microsoft have hit a rough patch, with OpenAI's executives discussing the option of accusing Microsoft of anticompetitive behaviour during their partnership, the Wall Street Journal reported on Monday, citing people familiar with the matter. The action may reportedly include a federal review of the contract terms for possible antitrust violations, along with launching a public campaign.
According to the report, the tensions stem from the terms of OpenAI's acquisition of Windsurf, an artificial intelligence tool for coding help. Microsoft's agreement with OpenAI gives it access to the startup's intellectual property, but OpenAI reportedly does not want the tech giant to access Windsurf's IP.
The report stated that the companies disagreed on how much of OpenAI Microsoft would own if it becomes a public-benefit corporation, as the tech conglomerate is allegedly currently asking for a larger stake in the new company than OpenAI is prepared to offer.
