Special Counsel Jack Smith plans to appeal the dismissal of the classified documents case against former President Donald Trump, his spokesman said on Monday.
It comes only hours after a federal judge dismissed the case against Trump and said Smith's appointment as a special counsel by the US Department of Justice was unconstitutional.
In June 2023, Trump was indicted by a grand jury on charges of mishandling official documents, including the classified government documents that were discovered at Trump's residence in Mar-a-Lago. In a separate case. the former president was indicted by a New York court on accounts of falsifying business records and eventually declared guilty on all accounts, with the sentencing due for September 18.
