Special Counsel Jack Smith urged the United States Supreme Court (SCOTUS) to dismiss former President Donald Trump's claims of immunity, asserting that such claims obstruct the fundamental principle that no individual, including the president, is above the law.
In a filing to the court on Monday, Smith emphasized that Trump's insistence on immunity contradicts the essence of the country's legal framework. "The former president’s constitutional duty to take care that the laws be faithfully executed does not entail a general right to violate them," Smith stated.
Smith contested Trump's argument that his actions related to the January 6, 2021, insurrection are protected by presidential immunity, arguing that even if Trump were entitled to some level of immunity, his actions were primarily aimed at personal objectives rather than official duties, making him subject to prosecution for private conduct.
