The European Court of Justice ruled in favor of Google LLC, Meta Platforms, and TikTok on Thursday, which faced stricter rules by the Austrian regulators seeking to impose stringent regulations targeting "illegal content" on their digital platforms.
The Court noted that European Union member states are not permitted to impose "measures of a general and abstract nature that apply without distinction to any provider of a category of information society services" unless they are the member state of origin for the service, as is the case with Ireland, where the headquarters of these platforms are located.
The Court of Justice clarified in the statement that such a "national approach" is in violation of EU law, highlighting the significance of preserving the concepts of free information flow within the bloc and control by the member state of origin.
