A District of Columbia federal appeals court ruled on Tuesday that former United States President Donald Trump cannot claim immunity from prosecution in his election subversion lawsuit. The court issued the decision after Trump appealed a ruling by District Judge Tanya Chutkan, who said that the presidency "does not confer a lifelong 'get-out-of-jail-free' pass."
Three appellate judges argued that "for the purpose of this criminal case, former President Trump has become citizen Trump, with all of the defenses of any other criminal defendant." They added that "any executive immunity that may have protected him while he served as President no longer protects him against this prosecution." Trump is likely to appeal to the Supreme Court, which is already set to take on the issue of Trump's eligibility for the 2024 presidential election.
